Effective Date: May 26, 2026
Last Updated: May 26, 2026
1. Introduction
Peter Soukup ("we," "us," "our," or "Company") operates the AA Birthdays mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App. Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access the App.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the App after the date such revised Privacy Policy is posted.
2. Information We Collect
We collect information that you voluntarily provide to us when you use the App. The specific information we collect depends on how you interact with our App and the features you choose to use.
2.1 Personal Information
None
2.2 Information We Do Not Collect
Our App does not collect:
- Email addresses
- Name
- Phone numbers
- Physical addresses
- Payment or financial information
- Social security numbers
- Biometric data
- Location data
- Device identifiers for advertising purposes
- Usage analytics or behavioral data
- Cookies or similar tracking technologies
- Information from third-party sources
3. How We Use Your Information
We use the information we collect in the following ways:
- To Provide App Functionality: The names you enter are used exclusively to enable the core functionality of the App, which is to help you track and remember birthdays.
- To Store Your Data Locally: All name information is stored locally on your iOS device to ensure the App functions properly and retains your entered data between sessions.
- To Enable Notifications: If you choose to enable notifications, the names you enter may be used to generate reminder notifications about upcoming birthdays.
- To Respond to Your Inquiries: If you contact us with questions or support requests, we may use any information you provide in your communication to respond appropriately.
We do not use your information for marketing purposes, advertising, analytics, or any other purposes beyond the core functionality of helping you track birthdays.
4. Data Storage and Security
4.1 Local Storage
All name data you enter into AA Birthdays is stored locally on your iOS device. We do not transmit, upload, or store your data on remote servers, cloud services, or any external databases. Your data remains entirely on your device under your control.
4.2 Security Measures
We implement appropriate technical and organizational security measures designed to protect the information stored by our App. The App leverages iOS security features, including:
- Encryption of data at rest using iOS device encryption
- Secure app sandboxing to prevent unauthorized access by other applications
- Protection through iOS security updates and patches
However, please be aware that no security measures are perfect or impenetrable. The security of your data also depends on the security measures you implement on your device, such as using a strong device passcode, enabling biometric authentication, and keeping your iOS software updated.
4.3 Your Responsibility
Because all data is stored locally on your device, you are responsible for:
- Maintaining the physical security of your device
- Using appropriate device lock mechanisms
- Creating backups of your data through iOS backup features if desired
- Being aware that uninstalling the App will delete all locally stored data
5. Data Sharing and Disclosure
We do not share, sell, rent, or trade your information with third parties for their commercial purposes. Because all data is stored locally on your device and we do not operate backend servers for this App, we do not have access to the names or other information you enter.
5.1 No Third-Party Services
AA Birthdays does not integrate with, utilize, or share data with any third-party services, including:
- Analytics services
- Advertising networks
- Social media platforms
- Cloud storage providers
- Data brokers
- Marketing services
5.2 Legal Obligations
While we do not have access to your locally stored data under normal circumstances, we may disclose information if we believe in good faith that such disclosure is necessary to:
- Comply with a legal obligation, such as a valid subpoena, court order, or other legal process
- Protect and defend our rights or property
- Prevent or investigate possible wrongdoing in connection with the App
- Protect the personal safety of users of the App or the public
- Protect against legal liability
However, given the local-only nature of data storage in our App, such scenarios are highly unlikely.
5.3 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of our assets, information about our App and users may be transferred or disclosed in connection with such transaction. In such an event, we will provide notice if your information becomes subject to a different privacy policy.
6. Data Retention
We retain the name information you enter into the App for as long as you choose to keep it stored in the App. Because data is stored locally on your device:
- You have complete control over your data retention
- You can delete individual entries at any time through the App interface
- Uninstalling the App will permanently delete all stored data from your device
- We do not maintain copies of your data on our servers
If you contact us via email for support, we may retain your correspondence for a reasonable period to maintain records of customer service interactions, typically not exceeding three years unless required by law.
7. Your Privacy Rights
Because all data in AA Birthdays is stored locally on your device and we do not collect or have access to this data, you maintain complete control over your information at all times.
7.1 Access and Control
You have the following rights regarding your data:
- Right to Access: You can view all names stored in the App at any time through the App interface.
- Right to Modify: You can edit or update any names you have entered at any time.
- Right to Delete: You can delete individual entries or all data by uninstalling the App.
- Right to Export: You may export your data using iOS backup and restore features.
7.2 State-Specific Privacy Rights
Depending on your state of residence, you may have additional privacy rights under applicable state laws.
7.2.1 California Residents
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:
- Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected the information, the business purpose for collecting the information, and the categories of third parties with whom we share the information.
- Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
- Right to Correct: You have the right to request correction of inaccurate personal information.
- Right to Opt-Out: You have the right to opt-out of the sale or sharing of your personal information. We do not sell or share your personal information.
- Right to Limit Use of Sensitive Personal Information: We do not collect or use sensitive personal information.
- Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising your privacy rights.
Given the local-only nature of data storage in our App, you can exercise these rights directly through the App interface without needing to contact us. However, if you have questions or need assistance, you may contact us at the email address provided in this Privacy Policy.
7.2.2 Virginia Residents
If you are a Virginia resident, you have rights under the Virginia Consumer Data Protection Act (VCDPA), including the right to access, correct, delete, and obtain a copy of your personal data, as well as the right to opt-out of targeted advertising, sale of personal data, and profiling. We do not engage in these activities.
7.2.3 Colorado Residents
If you are a Colorado resident, you have rights under the Colorado Privacy Act (CPA), including the right to access, correct, delete, and port your personal data, as well as the right to opt-out of targeted advertising, sale of personal data, and profiling. We do not engage in these activities.
7.2.4 Connecticut Residents
If you are a Connecticut resident, you have rights under the Connecticut Data Privacy Act (CTDPA), including the right to access, correct, delete, and port your personal data, as well as the right to opt-out of targeted advertising and sale of personal data. We do not engage in these activities.
7.2.5 Utah Residents
If you are a Utah resident, you have rights under the Utah Consumer Privacy Act (UCPA), including the right to access, delete, and port your personal data, as well as the right to opt-out of targeted advertising and sale of personal data. We do not engage in these activities.
8. Children's Privacy
Our App does not knowingly collect personal information from children under the age of 13. The App is not directed to children under 13, and we do not knowingly solicit or collect information from children under 13.
If you are a parent or guardian and believe that your child under 13 has provided information to our App, please contact us immediately at the email address provided below. If we discover that we have inadvertently collected information from a child under 13, we will take immediate steps to delete such information and terminate the child's access if applicable.
Given that our App stores all data locally and does not transmit data to our servers, the risk of us collecting children's information is minimal. However, parents and guardians should supervise their children's use of mobile applications and devices.
9. International Users
Our App is operated in the United States and is intended for users located in the United States. If you are accessing the App from outside the United States, please be aware that information you provide or that is collected may be transferred to, processed in, and held in the United States and other countries.
However, because AA Birthdays stores all data locally on your device and does not transmit data to our servers, international data transfer concerns are minimal. Your data remains on your device regardless of your location.
By using the App, you consent to the transfer of your information to the United States and acknowledge that the United States may have different data protection laws than your country of residence.
10. Do Not Track Signals
Some web browsers and devices permit you to broadcast a preference that you not be "tracked" online. Our App does not track users over time or across third-party websites or applications. Because we do not track users, we do not respond to Do Not Track (DNT) signals. We do not collect information about your online activities over time or across different websites or applications.
11. Third-Party Links and Services
Our App does not contain links to third-party websites or integrate with third-party services. We do not use third-party analytics, advertising networks, social media platforms, or other external services that might collect your information.
Should future versions of the App include any external links or integrations, this Privacy Policy will be updated accordingly, and you will be notified of such changes.
12. iOS Platform Permissions
The App may request certain permissions from your iOS device to function properly:
- Notifications: If you choose to enable notifications, the App will request permission to send you local notifications about upcoming birthdays. You can manage this permission in your device settings at any time.
- Calendar Access: The App may request access to your device calendar if you choose to integrate birthday reminders with your calendar. This permission is optional and can be denied or revoked at any time through your device settings.
You can review and modify these permissions at any time through your iOS device Settings app under the AA Birthdays section. Denying certain permissions may limit some functionality of the App but will not prevent you from using core features.
13. Data Breach Notification
While our App stores data locally and does not transmit it to servers, making traditional data breaches unlikely, we take data security seriously. In the unlikely event that we become aware of a security incident that could compromise your information, we will:
- Assess the nature and scope of the incident
- Take reasonable steps to remediate the issue
- Notify affected users in accordance with applicable law
- Cooperate with law enforcement if necessary
Given that data is stored locally on your device, you should immediately report any loss or theft of your device to local authorities and take appropriate steps such as remotely wiping your device if possible.
14. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. When we make changes to this Privacy Policy, we will:
- Update the "Last Updated" date at the top of this Privacy Policy
- Post the revised Privacy Policy within the App or on our website if available
- For material changes, provide additional notice through the App or via email if we have your email address
Your continued use of the App after any changes to this Privacy Policy constitutes your acceptance of such changes. We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.
Material changes may include but are not limited to:
- Changes in the types of information we collect
- Changes in how we use your information
- Changes in data sharing practices
- Introduction of third-party services or integrations
- Changes in data storage locations or methods

17. User Responsibilities
By using AA Birthdays, you acknowledge and agree that:
- You are responsible for maintaining the confidentiality and security of your device

- Any interruption or cessation of the App
- Any bugs, viruses, or other harmful code that may be transmitted through the App
- Any errors or omissions in any content or data
- Loss of data stored locally on your device
Because all data is stored locally on your device, you acknowledge that you are responsible for maintaining appropriate backups and that we have no ability to recover lost data.
19. Governing Law and Dispute Resolution
This Privacy Policy and any disputes arising out of or related to it or the App shall be governed by and construed in accordance with the laws of the United States and the state in which Peter Soukup operates, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Privacy Policy or the App shall be resolved through good faith negotiations. If the parties cannot resolve the dispute through negotiation, the dispute shall be resolved in the state or federal courts located in the applicable jurisdiction, and both parties consent to the personal jurisdiction of such courts.
20. Severability
If any provision of this Privacy Policy is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that this Privacy Policy shall otherwise remain in full force and effect and enforceable.
21. Entire Agreement
This Privacy Policy, together with any Terms of Service or End User License Agreement for the App, constitutes the entire agreement between you and Peter Soukup regarding the privacy aspects of your use of the App and supersedes all prior or contemporaneous understandings regarding such subject matter.
22. No Waiver
No waiver of any term of this Privacy Policy shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under this Privacy Policy shall not constitute a waiver of such right or provision.
23. Assignment
We may assign our rights and obligations under this Privacy Policy, including in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign your rights or obligations under this Privacy Policy without our prior written consent.
24. Acknowledgment
By using AA Birthdays, you acknowledge that you have read this Privacy Policy, understand it, and agree to be bound by its terms. If you do not agree to this Privacy Policy, you must not use the App.
Thank you for trusting Peter Soukup with AA Birthdays. We are committed to protecting your privacy and providing a secure, reliable app experience.
